TWIL Travel - Terms & Conditions
Introduction
The terms "TWIL Travel," "we," and "us" refer to TWIL Travel Corp., a company incorporated under the laws of Canada and the Province of Ontario. TWIL Travel Corp. is a registered member of the Travel Industry Council of Ontario (TICO) #50023133.
By booking travel with TWIL Travel, you (the "Client") agree to the following Terms & Conditions, which apply to all travelers in your party. These terms outline our role as a travel agency, the responsibilities of travelers, and important information regarding payments, cancellations, liability, and required travel documentation.
1. Our Role as a Travel Agency
TWIL Travel acts solely as a booking agent for third-party travel suppliers, including airlines, hotels, cruise lines, tour operators, transportation providers, and other travel-related services ("Suppliers"). We do not directly provide travel services and are not responsible for the actions, omissions, or service failures of these Suppliers. Each Supplier has its own Terms & Conditions, which you agree to when booking through TWIL Travel.
While TWIL Travel may provide travel advice, destination insights, or recommendations, such information is for general guidance only and should not be considered expert or legal advice. Clients are responsible for making informed decisions based on their individual needs.
TWIL Travel is not responsible for arrangements made independently outside our agency. If you book flights, accommodations, or other services on your own, we cannot assist with cancellations, refunds, or changes.
2. Prices, Payments & Cancellations
Pricing & Availability
All travel prices are subject to change until full payment is made. Errors in pricing may be corrected, and promotional offers are subject to availability.
Currency
Currency exchange rates fluctuate and prices are subject to change based on the current exchange rate. TWIL Travel is not responsible for surcharges or foreign transaction fees that may be imposed by your credit card, bank, or other preferred method of payment.
Payments
By providing a payment method (e.g., credit card authorization), you authorize TWIL Travel to process payments on your behalf for travel services. Failure to make full payment by the due date may result in cancellation and loss of deposits. Some Suppliers may charge a credit card processing fee when using a credit card for payment. Additionally, wire payments may be subject to additional wire transfer fees.
Right to Correct Errors and Offers Subject to Availability
TWIL Travel reserves the right to correct errors. In the event of any pricing error or omission, we reserve the right to adjust such pricing or make any other corrections. All offers, incentives, and Supplier promotions are subject to availability and may change without notice. You are advised to confirm reservations well in advance of your anticipated dates of travel to avoid disappointment, increases in fares, and additional late booking fees.
Cancellations & Refunds
Cancellation policies vary by Supplier. Some bookings may be non-refundable as soon as they are confirmed. If you cancel your trip, cancellation fees will apply according to each Supplier’s policy. TWIL Travel does not provide refunds beyond what Suppliers allow.
All cancellation requests must be submitted in writing. If you dispute a charge for a confirmed booking, you may be responsible for additional fees, including legal costs.
TWIL Ticketing and Trip Planning fees are always non-refundable once paid.
3. Changes to your Trip
Changes by the Client
Changes to the itinerary once the trip is confirmed must be made in writing. TWIL Travel will do its best to accommodate change requests, however, changes may incur additional costs and/or non-refundable deposit payments in addition to the amount originally quoted. Please note that certain bookings may not be able to be changed and you may not be entitled to any refund for unused portions of travel.
Unforeseeable Changes
At times, unexpected events—like flight cancellations, schedule adjustments by airlines or hotels, extreme weather, or regional incidents—may necessitate changes to your confirmed itinerary. When such situations arise, TWIL Travel make every effort to adjust your plans smoothly, aiming to preserve the overall flow and minimize any additional costs to your trip. However, if these adjustments lead to increased expenses, you'll be responsible for covering the difference.
This approach ensures transparency and keeps you informed about potential changes and associated costs.
4. Travel Documents & Requirements
It is your responsibility to ensure that all travelers in your party have valid passports, visas, and any other required documentation for your destination.
Passports: Must be valid for at least six (6) months beyond your return date.
Visas & Entry Requirements: Some countries require visas, travel authorizations (e.g., eTAs), or proof of onward travel. It is your responsibility to check these requirements.
Minors Traveling: Additional documentation may be required for minors traveling without both parents or legal guardians
Travel Documents: Upon receiving your travel documents, please review and verify all documentation for accuracy, including your names as per passport and your itinerary, very carefully. Any changes or modifications must be communicated in writing to TWIL Travel within 24 hours of receipt, or may be subject to additional fees.
TWIL Travel is not responsible for any denied boarding, refusal of entry, or travel disruptions due to incomplete or incorrect documentation.
5. Travel Insurance
We strongly recommend purchasing comprehensive travel insurance to protect against trip cancellations, medical emergencies, lost baggage, and other unexpected situations. TWIL Travel can provide insurance options, but we are not an insurance provider and cannot guarantee claims will be approved. If you choose to decline insurance, you acknowledge and accept full financial responsibility for any losses resulting from trip interruption, cancellation, or other unforeseen events. 6. Travel Risks & Health Precautions
Travel involves risks, including delays, cancellations, natural disasters, and political instability. It is your responsibility to stay informed about your destination’s safety conditions.
Health & Vaccinations: Some destinations require vaccinations or health screenings. Check with your healthcare provider or the Government of Canada’s travel advisory website.
COVID-19 & Other Health Risks: Entry requirements, testing, and quarantine rules may change. You are responsible for compliance with health regulations at your destination.
Travel Involves Risk: Travel inherently involves risks. Some destinations may have different standards of transportation, communication, and healthcare compared to your home country. Medical facilities may be limited or difficult to access. The services provided by independent Suppliers are subject to the laws of the country where they operate and may be governed by specific Supplier policies, tariffs, or conditions of carriage.
It is your responsibility to know if you, or anyone travelling with you, if applicable, has any physical or other condition or limitation that would make travelling unsafe for you or other Travellers. Please consult your healthcare provider before travelling and ensure you meet all requirements and have taken all necessary precautions.
TWIL Travel is not responsible for travel disruptions due to health risks, government advisories, or Supplier policies.
7. Airline Policies & Responsibilities
TWIL Travel acts as an agent for airline bookings. The airline ticket is a contract between you and the airline. We are not responsible for airline schedule changes, cancellations, lost baggage, or denied boarding due to documentation issues.
Flight Changes & Cancellations: Airlines may modify schedules, cancel flights, or deny boarding. Compensation, if applicable, must be claimed directly from the airline.
Baggage Allowances & Fees: Each airline has its own baggage policies. Fees may apply for checked or carry-on baggage.
Seat Assignments: Airlines control seat selection and may change assigned seats at their discretion, including pre-paid seat assignments.
TWIL Travel does not offer assistance with loyalty program point redemptions for flights or other travel products and services.
8. Supplier Liability & Force Majeure
TWIL Travel is not liable for acts or omissions of third-party Suppliers, including travel delays, overbookings, mechanical failures, strikes, weather disruptions, or other unforeseen events ("force majeure"). In such cases, refunds or credits are subject to each Supplier’s policies.
In the event of a force majeure situation, TWIL Travel is not responsible for any loss of funds. Refunds or credits, if any, are subject solely to the terms and conditions of the relevant Supplier(s). Clients are encouraged to obtain travel insurance that includes coverage for trip interruption and cancellation due to unforeseen circumstances.
By booking with TWIL Travel, you acknowledge that travel involves risks and agree to hold TWIL Travel harmless for circumstances beyond our control.
In addition and without limitation, TWIL Travel is not responsible for any injury, loss, or death, or damage to property in connection with the provision of any goods or services whether resulting from, without limitation, acts of God or force majeure, weather, quarantines, illness, disease, acts of war, civil unrest, insurrection/revolt, animals, labor unrest including strikes, criminal or terrorist activities of any kind, overbooking or downgrading of services, food poisoning, mechanical or other failure of means of transportation or travel delays, travel advisories or warnings.
9. Client Conduct & Responsibility
By booking travel with TWIL Travel, you agree to:
Follow all travel rules and regulations, including Supplier policies.
Be responsible for any damages caused by your actions.
Refrain from illegal activities during your trip. TWIL Travel is not responsible for consequences arising from illegal or prohibited conduct.
10. Privacy
Your privacy is of utmost importance to us. TWIL Travel is required to collect personal information (such as passport details, credit card numbers, etc.) in order to plan your trip. We appreciate the sensitive nature of this information and will not share it with third parties (other than as required for booking air, hotel, or other reservations as a part of your trip) without your express written permission.
11. Changes to These Terms
TWIL Travel reserves the right to update these Terms & Conditions at any time. The most recent version will be available on our website and will apply to all bookings moving forward.
12. Governing Law
These Terms & Conditions are governed by the laws of the Province of Ontario, Canada. In the event of a dispute that cannot be resolved amicably, the parties agree to submit to the exclusive jurisdiction of the courts of Ontario.
13. Agreement
By booking travel with TWIL Travel, you confirm that you have read, understood, and agreed to these Terms & Conditions. You also agree to share these terms with all members of your travel party.
